Terms and Conditions 

These Terms and Conditions shall be incorporated into the Application Form and shall be referred to in these Terms and Conditions as Terms. By signing the Application Form you agree to these Terms and Conditions and you agree to adhere to all policies and information given to you at the time of enrolment and induction and/or published on our Website at www.smilewisdom.co.uk or incorporated in the Website Terms and Conditions. They may be updated from time to time.  Policies not published on our Website can be made available for inspection upon your written request.

Please read these Terms before signing the Application Form. You should take independent legal advice if you are uncertain of the effect of any of the provisions in these Terms.

  1. ENROLLMENT REQUIREMENTS

Application Form

You are required to complete and sign the Application Form and send your Application Form to us by email to Training@smilewisdom.co.uk.

Where, as part of your enrolment process, you are asked to submit documents (i.e. a copy of your passport with photo ID or Driver’s license with photo ID) listed in the Application Form and / or requested by us in our communication to you, you are required to submit these documents as well.

You agree to keep your contact details provided to us with your enrolment up to date.

Assessment of students’ suitability

Once we receive your signed Application Form we will assess your suitability to enrol in the Course.

You must have the legal capacity and are free contractually to accept these Terms and are at least 18 years old.

We require that all students have a good level of written and spoken English and maths. In order to assess your language skills you may be asked to sit a short, basic English skills and /or maths test with us at the interview stage. Plus comply with the course entry conditions to be found on the website www.smilewisdom.co.uk

Please note that you must have the right to work and study in the UK. All students are solely responsible to obtain the permission to work and study in the UK before paying the Deposit. We can’t be liable for the failure of students to obtain permission to work and study in the UK. No refunds will be given to students that withdraw from the Course, before or after the start date, due to the fact that they have not obtained the permits or have failed to maintain the permits during the Course.

Payment of Deposit

Once we have approved your application, you will be required to pay a non-refundable, non-transferable and non-exchangeable Deposit in the amount of £150.00 (incl. VAT) before the start date. Payment of the Deposit should secure a position on the Course.

 

  1. FORMATION OF THE CONTRACT

Where your application has been approved, and you have paid the Deposit, we will issue you an email confirmation of your enrolment and your admission for the Course will be deemed complete, and a binding contract is formed between you and us. You will then be required to pay the full Course fee as set out in these Terms. See clause 7 below.

 

  1. MEDICAL ADVICE

Please note before working as a dental nurse you must be vaccinated against Hepatitis B and if possible produce satisfactory evidence of immunizations against Hepatitis B.

 

  1. COURSE START DATE

This Course is typically six months in duration.

  1. NEBDN EXAMINATION FEES

All applicants wishing to sit the exam will be required to pay an examination fee (currently) £205.00. The amount of the examination fee is determined by the National Examination Board for Dental Nursing (NEBDN) and is subject to changes made by the NEBDN.

You will need to submit this examination fee to us before you will be entered into the examination(s).

Examination deferral fees or re-sit examination fees may also be payable before confirming your right to sit a NEBDN Examination.

In all cases your SmileWisdom course fees will need to be up to date before we pay the NEBDN examination fee(s). Any amounts you pay to us may be used to satisfy course fees due at the time of payment in priority to other payments, including examination fees.

 

  1. PAYMENT OF COURSE FEE

Deposit and interest free instalment payment

You must pay the full Course fee in the amount of £900.00 (incl. VAT).

The first payment you are required to make before the Course start date is a non-refundable, non-transferable and non-exchangeable Deposit in the amount of £150.00 (incl. VAT).

You agree to pay the remaining Course fee balance in 6 monthly equal instalments of £125.00 (incl. VAT).

All payments must be in UK Pounds Sterling. The Course fees are due in full even if you decide to withdraw from the Course. Upon withdrawal, you will still be liable to pay the Course fee in accordance with these Terms.

Schedule of payment

All monthly instalments must be paid by the end of each month starting from the month you started the course.  For example, if you start the course on March 15th the first instalment will be due by 31st March.

Monthly instalments and all unpaid sums due and payable after any applicable due period herein will automatically accrue a late charge of £10.00 (incl. VAT) per week. For example, if you fail to make your payment of any monthly instalment by bank transfer to our account in due course (by the end of each month) or if the bank returns your cheque as unpaid for any reason, or if your credit card declines or your direct debit fails you will be liable for a late charge of £10.00 (incl. VAT) per week, and part week.

Failing to make payments as scheduled will result in forfeiture of all payments made (including Deposit). The deposit is not refundable.

Where you fail to make the overdue payment, we will reserve the right to recover any such amount (Course fees, charges, etc) and use any available legal means and method of recovery.

  1. CANCELLATION AND REFUND

Cooling off period

You shall be admitted to the Course from the day we receive your Deposit payment and issue you a confirmation of your enrolment and therefore, the refund period, applicable in limited cases, also starts from that date.

You are entitled to cancel the contract within 14 days from the formation of the contract (“cooling off period”). If you cancel within the cooling off period we will refund you the Deposit you paid to us.

You must communicate your cancellation within the cooling off period to us in writing by emailing Training@smilewisdom.co.uk.

Your cancellation will only take effect when it is received in writing by us at the above mentioned address or email and will be effective from the date on which we receive it. 

Cancellations by phone will need to be accompanied by email or letter to the above address otherwise they may not be accepted. You must keep evidence of your cancellation within the ‘cooling off period’.

Please note: If the contract was formed fourteen (14) days or less before the start of the Course you lose your right to a cooling off period.

Cancellation and refunds

We will not either partly or fully refund any part of your Course fee to you where you decide to withdraw from the Course at any time, whether before or after the start of the Course, other than as stated above. In addition, any balance of the remaining full price of the Course fees must be paid in full at or before the time they fall due.

In the unlikely event of the course being cancelled by us, all students will be given alternate course dates, subject to availability. On agreeing to the delay and continuing with your enrolment you remain bound by these Terms.

Where you fail to attend the Course for any reason, except the unlikely event the course being cancelled by us, will not entitle you to access to a course at a later date nor to refunds of the Course fees or Deposit paid to us.

If you are unable to attend the new start date determined by us, you will have the option of receiving a full refund of your Deposit should you decide to cancel the Course. You must communicate your cancellation to us within 7 days of receipt of our notice or, if the course was due to commence before the expiry of that period, before the commencement of the Course in writing by email to Training@smilewisdom.co.uk.

Your cancellation will only take effect when it is received in writing by us at the above mentioned address or email and will be effective from the date on which we receive it. Deposit or any part of the Course fees will not be refunded if the Course is interrupted or cancelled due to an act of God or terrorist act, natural disaster, medical epidemic or pandemic, government action, or other event beyond our reasonable control.

 

  1. OPTION TO JOIN ANOTHER COHORT / RESTART THE COURSE

If you have already paid the Deposit but are unable to start the Course and wish to move to a later cohort, we will allow you to join another cohort where possible, provided a written notice is received by us no later than 7 days prior to the Course start date.

Where you wish to move to another cohort partway through the Course we will allow you to join another cohort where possible, however, you will be required to pay an administration charge of £99.00 (incl. VAT) prior to your move.

Please note that both options are looked at on a case-by-case basis.

If you have decided to leave the Course and were given a leaving notification from us, and then decide to re-join the Course from the beginning, you will be required to pay the full Course fee (Deposit in the amount of £150.00 (incl. VAT) and 6 equal instalments of £125.00 (incl. VAT) per month.

Where you have already paid the full Course fee however yet wish to, or are required to, continue as you did not achieve the required results in the mock exam/s, you will continue the Course until the next NEBDN / Mock examination date.

Please note that all course extensions will result with your obligation to make further monthly payments of £125.00 (incl. VAT).

 

  1. STUDY MATERIALS

Course books are not included in the Course fees so students should purchase their own course books prior to the Course.

 

  1. RESPONSIBILITIES OF THE STUDENT

By agreeing to these Terms you undertake to:

  • comply with these Terms;
  • pay Course fees on time and fulfil all financial obligations in accordance with these Terms;
  • provide truthful, accurate and complete information for the purpose of enrolment for the Course;
  • attend all your training and assessment sessions on time;
  • making sure that attendance shall not fall below 80% (should it fall below 80% you will not be permitted to sit examinations);
  • be polite and respectful to other learners and SmileWisdom Staff and comply with our Equal Opportunities Policy see www.smilewisodm.co.uk at all times;
  • let a member of staff know if you feel you have been treated unfairly or have been bullied and harassed whilst on your training programme;
  • secure your right to work and study in the UK when you register for the Course;
  • work hard to achieve your goals and targets;
  • complete all your work and sit any tests or examinations agreed;
  • let us know without delay if your circumstances change or you need to update any of the information on your Individual Learning Plan;
  • let us know without delay if you are not happy with any part of your training or your treatment on your course by using our Complaints Procedure see www.smilewisdom.co.uk;
  • be careful not to cause harm to others through reckless or careless behaviour and report any hazards you come across either at the Training Centre or in your place of work.

Failure by you to comply with the undertaking set out above may result in your removal or dismissal from the Course and, in such circumstance, you will not be entitled to any refund or other payment, and any balance of the remaining full price of the Course fees must be paid in full at or before the time they would have fallen due.

 

  1. RIGHTS AND RESPONSIBILITIES OF SMILEWISDOM

SmileWisdom reserves the right to:

  • Asses your applications and allow enrolment or reject or withdraw or amend our offer or terminate enrolment at any stage of the process we deem appropriate and in line with the enrolment requirements;
  • terminate your enrolment where we have reason to believe that you made a false or incorrect statement during your enrolment process;
  • assess your training needs and agree how we will meet them;
  • alter dates, Course fees, charges and other information published on our Website and in these Terms without prior notice;
  • refer you to another service if we are not able to help you;

SmileWisdom will adhere to and:

  • provide you with free information and advice about the training we offer;
  • develop an Individual Learning Plan with you that has clear goals and targets and meets your aspirations;
  • give you regular feedback about the progress you are making;
  • give you ongoing advice and support to help you complete your training successfully;
  • give you regular opportunities to give us feedback about all aspects of your training;
  • work with your employers and job providers to make sure you receive effective training and support from them;
  • make sure you are treated courteously, fairly and with respect by everyone involved in your training;
  • make sure that training and assessment activities are carried out in a safe environment.

We are not liable for any failure to perform any of our obligations under these Terms caused by matters beyond our reasonable control. Nothing in these Conditions affects your legal rights. Advice about your legal rights is available from your local Citizens Advice Bureau.

 

  1. DATA PROTECTION 

All personal information supplied by you for the purpose of enrolment process and undertaking the Course will be protected in line with our Privacy Policy. www.smilewisdom.co.uk

 

  1. COMPLAINTS

We are certain you will be satisfied with our service, but if you wish to complain about any dealing that you have with us please follow our complaints policy on www.smilewisdom.co.uk and contact us in one of the following manners:

 

  1. LIMITATION OF LIABILITY  

We do not exclude or limit in any way our liability to you where it would be our Complaint Policy published on our Website unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees and for fraud or fraudulent misrepresentation.

Except as expressly set out in the Terms, we exclude all implied conditions, warranties, representations or other terms that may apply or may be incorporated into this Terms by statute, common law, or otherwise and any liabilities arising from them are expressly excluded to the extent permitted by law.

We (including our parent, subsidiaries, affiliates, directors, agents and employees) will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in any way in connection with this Terms of Use and / or individual Terms and Conditions. In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

In the event that any limitation or exclusion of liability in the Terms is not enforceable, the total aggregate liability of SmileWisdom in contract, tort (including without limitation negligence), statutory duty or otherwise, in respect of all claims arising under or in connection with these Terms shall not be more than the amount of your course fees (paid or payable).

Each of the provisions of this section “Limitation of Liability” shall be construed separately and independently of the others.

 

  1. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in all materials and works we provide you during the Course. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. All trademarks, names and logos are the proprietary marks of SmileWisdom. Marks identifying third parties are owned or licensed by those third parties or their associated companies. No conditions within these Terms confer on you any licence or right under any trademarks, names or logos.

Unless, by exemption permitted within these Terms, you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents in relation to the materials and works we provide you during the Course.

 

  1. MISCELLANEOUS

We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens, and we will ensure that the transfer will not affect your rights under these Terms.

These Terms constitute the entire agreement between you and us and supersede all previous arrangements, communications and representations (other than fraudulent misrepresentations) whether written or oral.

A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

If any of the provisions of these Terms are found illegal or unenforceable, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from these Terms and shall in no way affect the legality, validity or enforceability of the remaining terms which shall continue in full force and effect.

No failure or delay by us or you to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

You acknowledge that you have placed no reliance on any representation made but not set out expressly in the Terms.

The Terms shall be subject to the laws of England and Wales and the parties shall submit to the exclusive jurisdiction of the English courts, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

  • Be a registered dental nurse with the General Dental Council (GDC)
  • Be legally allowed to work in the UK
  • Have a supportive employer to supervise your electronic Records of Competence (RoC) completion
  • Have a valid First Aid/Basic Life Support (BLS) certificate of completion
  • Be competent in written and spoken English to be able to communicate effectively with patients, their families and dental and healthcare professionals.
  • Be self-motivated

Course Fees

  • The total course fee of £900 includes the deposit of £150.

  • The total course fee of £900 is payable should you leave the course at any time, less any amount already paid.
  • If your course is completed, yet you continue to attend the lessons for any reason the £125 monthly fees will continue.
  • Should you decide to move to another course cohort, i.e., at a different time or day, there will be a fee of £99.
  • Fees are payable at the end of the calendar month. A late payment fee of £10 (incl. VAT) per week or part week, will apply from the 1st of the following month.
